Engio Candidate Referral Terms and Conditions

1. Definitions

·      Engio: PT. Engio Nusalenta Global., its employees, and its recruitment platform.

·      You (Referrer): Any individual or organization using Engio's platform to refer candidates.

·      Client: The company seeking to hire candidates through Engio.

·      Candidate: The person referred to the Client by you.

·      Services: The services provided by Engio's recruitment platform.

·      Services Usage Fee: The fee paid to Engio by the Client.

·      Force Majeure Event: An unforeseen event beyond reasonable control, as defined by law.

2. General Terms

·      Agreement: By using Engio's services, you agree to these terms, Engio's policies, and any future modifications.

·      Modifications: Engio may update these terms at any time, and continued use of the platform constitutes acceptance of any changes.

·      Engio's Role: Engio is a recruitment agency facilitating connections between Referrers and Clients. While Engio provides the platform for these connections and may offer additional recruitment services, it is not liable for the actions taken by Referrers or the outcomes of their referrals.

3. Referral Rewards

·      Payment Schedule:

o  25% after 30 days of candidate employment.

o  25% after 60 days of candidate employment.

o  50% after the official employment contract is signed or passed the probation period.

·      Referral Limits: None.

·      Quality Standards: Engio can reject unqualified referrals, providing reasons.

·      Payment Condition: Rewards depend on the Client paying the Services Usage Fee.

4. Payment Terms

·      Payment Amount: As per Section 3, with potential deductions.

·      Platform Usage Fee: Engio may deduct up to 50% from self-referred candidates' rewards.

·      Incomplete Information: Rewards may be halved if candidate information is lacking.

·      Payment Schedule: On the 18th of each month, minus 11% income tax.

·      Payment Method: Bank transfer, with potential fees for you.

·      Claim Period: 7 days from receiving the income statement.

5. Warranty

·      90-Day Warranty: Engio offers a 90-day warranty from the candidate's start date.

6. Personal Data Protection

·      Data Collection and Use: Engio collects and uses your personal data for service provision, communication, and legal compliance. You can opt out of marketing communications.

·      Data Accuracy: Keep your information updated to avoid service disruptions.

7. Referrer Warranties and Commitments

·      Authorization and Compliance: You have the authority to use Engio's services, comply with laws and these terms, and not infringe on third-party rights.

·      Profile Accuracy: Use your real name and a clear photo of yourself.

·      Non-Solicitation: You won't solicit Engio's clients for similar services.

·      Content Removal: Engio can remove content violating these terms.

·      Liability: You're responsible for your content and actions on the platform.

8. Intellectual Property Rights

·      Engio's Ownership: Engio owns all rights to its platform and related intellectual property.

·      Confidentiality: You'll keep Engio's confidential information private.

·      Client Promotion: Don't use a Client's logo or name without permission.

9. Engio's Role

·      Support and Neutrality: Engio provides support during the recruitment process and remains neutral towards all parties.

·      Fee Collection: Engio collects the Services Usage Fee from Clients for successful referrals.

10. Dispute Resolution

·      Client-Referrer Disputes: Handled directly between the parties.

·      Engio-Referrer Disputes: Resolved through negotiation, then legal action if needed.

·      Candidate Privacy: Engio protects candidate privacy and can stop your activities if you misuse their information.

11. Limitation of Liability

·      Referrer Responsibility: You're solely responsible for your actions and any third-party claims.

·      Engio's Non-Involvement: Engio isn't liable for any disputes or issues between you and third parties.

12. Compliance and Breach Handling

·      Engio's Right to Terminate: Engio can suspend or terminate accounts violating these terms.

·      Penalties: Violations may result in fines and account freezing.

13. Termination

·      Termination Conditions: This Agreement terminates when your relationship with Engio as a referrer ends.

14. Severability

·      Invalid Provisions: If any provision is invalid, the rest of the Agreement remains in effect.

15. Entire Agreement

·      Completeness: This Agreement is the complete understanding between you and Engio.

Referrer Rules of Conduct

To ensure quality service, follow these guidelines:

·      Provide accurate information about yourself, the candidate, and the position.

·      Only refer job-seeking candidates.

·      Communicate through Engio's system.

·      Be respectful and professional in all interactions.

Violations may result in account deactivation.
